SOLID GOLD LOYALTY PROGRAM TERMS AND CONDITIONS

These Terms and Conditions (hereinafter called “Conditions”) govern the Solid Gold Loyalty Program (hereinafter called “Solid Gold Loyalty Program” or “Program”) operated by or on behalf of Solid Gold Pet LLC (hereinafter called “SOLID GOLD” or “We”) and the relationship between SOLID GOLD with members (hereinafter called “Members” or “You”) of the Program (hereinafter called “Membership”). Membership of the Program is subject to these Conditions and their amendments and modifications made by SOLID GOLD PET LLC from time to time without prior notice. SOLID GOLD reserves the right to amend or modify these Conditions or to change, replace, suspend, cancel or discontinue any Program benefits, services, rewards, rules and regulations at its discretion at any time without any prior notice to Members. By using your Membership credentials to redeem benefits and services associated with the Program, you agree that:
a. you have read, understood and accepted these Conditions;
b. you are eligible for Membership; and
c. you consent to SOLID GOLD PET LLC processing your personal data, in accordance with the personal data and privacy policy set out in Section 3.

1. MEMBERSHIP WITH THE PROGRAM
1.1 When you are accepted by us to be the Member of the Program, you will be assigned a Username and Password. Once you login the first time, you will then create your own password to receive details of Program benefits.
1.2 Membership is complimentary and is available only to Petfood industry individuals, not to companies, partnerships, associations, groups or other entities. You may not have more than one membership or any form of joint membership. It is your responsibility to ensure your eligibility and you will indemnify SOLID GOLD PET LLC against all liabilities, costs, claims, and/or expenses incurred for any breach of this provision. SOLID GOLD may refuse Membership without giving a reason.
1.3 Upon successful enrolment, Members will be approved by SOLID GOLD PET LLC company and will then receive the SOLID GOLD LOYALTY PROGRAM welcome letter with Username and Password information.
1.4 Membership entitles members to benefits according to entitlements information within these terms and conditions.
1.5 Membership of the SOLID GOLD LOYALTY PROGRAM are not transferrable and may only be used by the registered member.
1.6 You may cancel your Membership at any time with written notification to SOLID GOLD PET LLC. Cancellation is immediately effective upon receipt of your cancellation request and all membership entitlements will be forgone upon such cancellation.
1.7 SOLID GOLD reserves the right to discontinue the SOLID GOLD LOYALTY PROGRAM membership of any Member who is found to be using the Program in a manner inconsistent with the Terms and Conditions or intent of the Program or any portion of the Program. SOLID GOLD also reserves the right to discontinue membership of any Member who acts in a manner inconsistent with the spirit of the SOLID GOLD LOYALTY PROGRAM. Discontinued membership will result in the loss of all membership entitlements.
1.8 SOLID GOLD PET LLC reserves the right to add, modify, delete or otherwise change any of the terms, conditions, benefits and services pertaining to the Program at its sole discretion, at any time and without prior notice.
1.9 All interpretations of the Program’s Terms and Conditions shall be at the sole discretion of SOLID GOLD PET LLC.

2. ENTITLEMENTS
2.1 SOLID GOLD LOYALTY PROGRAM is designed for the member to earn points by participating training modules, viewing videos, documents, answering polls and quizzes, reviewing notifications, login to the system.
2.2 SOLID GOLD reserves the right to not assign a point based reward to any content within the portal without any prior notification. Not all content will have rewards points attached to it.
2.3 Members can redeem their points in the digital giftcard rewards catalog that will be provided by SOLID GOLD LOYALTY PROGRAM within the portal.
2.4 Once a member redeems for a digital gift card, the order may not be canceled, changed or edited.

3. DATA PRIVACY
3.1 The personal data supplied by Members will be used for the operation of the SOLID GOLD LOYALTY PROGRAM, delivery of associated benefits and services, Program development and to communicate news and information to Members for their benefits. SOLID GOLD collects personal data of Members (both offline and online) so as to provide an experience of the SOLID GOLD LOYALTY PROGRAM that is tailored to their preferences.
3.2 In addition, SOLID GOLD will use the personal data supplied by Members for direct marketing activities as detailed in Section 3.3 and 3.4 below. SOLID GOLD will not use your personal data unless we have received your consent.
3.3 Personal data supplied by Members will be used for direct marketing activities in relation to the following classes of services, products and subjects:
(i) products and services offered by SOLID GOLD PET LLC
(ii) benefits and news and events offered by SOLID GOLD LOYALTY PROGRAM

3.4 SOLID GOLD shall use the following personal data held by us from time to time for the direct marketing activities detailed in Section 3.3:
(i) Name
(ii) Email
(iii) Address
(iv) Phone no.
(v) Company Name
3.5 Since the privacy of Members is of paramount importance to SOLID GOLD PET LLC, we wish to protect it and maintain the trust of our Members while collecting the information necessary to operate this Program. SOLID GOLD is fully committed to providing information about the collection and use of personal data furnished by, or collected from, Members while using our websites, products and services. If you do not wish SOLID GOLD PET LLC to use your personal data for use in direct marketing as described, you may exercise your opt-out right by notifying us at any time without charge, via email at [email protected]
3.6 Members have the right to review, amend and update any personal data held by SOLID GOLD. Members’ details, profiles and loyalty program progress can be accessed at any time online by individual Members. The Member-restricted access is password-secured and allows you to view your accumulated points as well as to update your contact details.
3.7 Members have the responsibility of keeping SOLID GOLD LOYALTY PROGRAM up-to-date as to their correct communication address.
3.8 SOLID GOLD PET LLC will only use and disclose Members’ data to any vendors and suppliers including system developers, campaign management companies, call centres, research companies, fulfilment companies and telecom service providers SOLID GOLD engages to process data on its behalf for the purpose of operating this Program as detailed in Section 3.1.

4. GENERAL
4.1 These Terms and Conditions and the relationship between SOLID GOLD LOYALTY PROGRAM Members are governed by, and shall be construed in accordance with, the laws of State of Missouri.
4.3 Members shall indemnify and hold harmless SOLID GOLD PET LLC, its officers, directors, employees and agents (collectively "Representatives") from and against any and all liabilities, damages, losses, expenses, claims, demands, suits, fines or judgements (including, without limitation, any reasonable legal fees, costs and related expenses) incurred or suffered by SOLID GOLD PET LLC and its Representatives as a result of any claims or proceedings brought by any third party, arising out of or in connection with any breach of obligations hereunder or negligence or wilful misconduct on the part of a Member.
